What This Privacy Policy Covers
This Privacy Policy applies when you interact with Cozi, a family calendaring application, through our websites, mobile apps, e-mail communications, and other interactive features ("Platforms"). Cozi is offered by OurFamilyWizard, LLC.
This Privacy Policy (together with our Terms of Use) sets out the basis on which any personal data we collect from you (through the Platforms or otherwise) or from other sources, or that you provide to us, will be processed by us.
OurFamilyWizard, LLC (referred to as “OurFamilyWizard”, “we”, “us” or “our” in this Privacy Policy) is the controller of your personal data and is responsible for your personal data when it is processed by the Platforms.
This policy only applies to processing carried out by OurFamilyWizard. The Appstore provider or operator from whom you download the App will have its own privacy policy. The Platforms may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these sites, please note that they have their own privacy policies and that we do not accept any responsibility or liability for any of these policies. Please check these policies before you submit any personal data to these organizations.
Information Collection
When you visit the Platforms, we collect certain Personal Information, as well as Non-Personal Information.
“Personal Information” means any information about an identifiable individual, as further defined under applicable laws. We collect Personal Information when you submit it to the Platforms (for example when you sign up for or when you email invite other members). The Personal Information collected may include your name, email address, and IP address. In some cases, if we ask you to provide Personal Information, the provision of that information will be mandatory to participate in a particular activity, service or promotion. If you do not provide this Personal Information, your participation in that activity, service or promotion may be limited or prohibited. For example, if you choose not to provide your Personal Information in a required field when you sign-up for an account, you may not become a customer of Cozi.
“Non-Personal Information” means data in a form that does not include direct or indirect association with an identifiable individual, such as gender, language, zip code, area code, unique device identifier, location and time zone where a Platform is used, and information about customer activities on the Platform, to allow us to better understand customer behavior and improve the services, products and advertising. We collect some of this Non-Personal Information automatically when you visit the Platforms (Ad ID, IDFA, Google Advertising ID).
Where you voluntarily disclose additional personal information without being prompted by us and we are not made aware that it should take special care in handling such information, then we will not be held liable for that information under this Privacy Policy unless and to the extent that we are obliged to use and protect such personal information pursuant to and in accordance with applicable law.
Use of Collected Information
We will only use Personal Information for the purposes set out in this Privacy Polciy, with your consent or as required or permitted by law. Consent may be express or implied, and given in writing, by using or not using a check-off box, electronically, orally, or by your conduct, such as by visiting the Platforms and by using services or products offered through the Platforms. You agree that the consent given electronically should have the same effect as that given in writing. In some jurisdictions implied consent is not sufficient, in which case, express consent will be required.
We process and use the Personal Information we collect for the following purposes:
- to enable the features you are using;
- to operate, develop and improve its web sites, business, products, services, content and advertising;
- to inform you of product announcements, software updates and services;
- to provide you with more effective customer service;
- to analyze our business, products and other services; and
- to detect fraud and abuse, and as otherwise described in the Terms of Use, and if you have a Cozi device, your End User License Agreement.
We may also process, access, use, store and disclose Personal Information to enforce the terms and policies governing your use of the Platforms (including investigation of any potential violation), to detect or prevent security breaches, fraudulent activity or technical issues, to protect the rights or property of OurFamilyWizard and its customers.
Also, we may use your Personal Information to communicate with you; We may send service communications such as welcome emails, information on technical service issues, and security announcements, as well as information about changes to our terms, conditions and policies.
We may also occasionally send you product surveys or promotional mailings to inform you about other products or services available from OurFamilyWizard, and to fulfill promotions. Personal Information collected through the Platforms may be stored and processed in the EEA, USA and any other country in which OurFamilyWizard or its service providers maintain facilities. By using the Platforms, you consent to the transfer, recording and storage of information outside of the country where you reside.
While in another jurisdiction for processing, the information may be accessed by the courts, law enforcement and national security authorities. OurFamilyWizard may use your Personal Information from the day you submit it to the day it is deleted, whether as a result of deletion due to a request by you to delete it, or for another reason.
OurFamilyWizard retains your Personal Data until it is no longer necessary to provide you with the Service, or until your account is deleted.
Sharing Personal Information
Except as described in this Privacy Policy or otherwise as permitted by law, OurFamilyWizard’s practice is to not disclose Personal Information about you outside of OurFamilyWizard and its affiliates without your consent. You hereby consent to the disclosure of your Personal Information as outlined in this Privacy Policy. We may disclose the Personal Information to our third party service providers so they may complete transactions or perform services on our behalf, transactions on your behalf, or transactions related to providing services to you. For example, we may contract with third parties to host the Platforms, collect and provide product reviews, provide promotions or surveys, send Cozi emails, and fulfill product orders and promotions.
We will use contractual agreements to protect Personal Information disclosed to third party service providers. We may also access, use, store and disclose Personal Information to comply with the law and lawful requests or legal process, enforce the terms and policies governing your use of the Platforms including investigations of any potential violation, to detect or prevent security, fraud or technical issues, to protect the rights or property of OurFamilyWizard and its customers, and when we believe in good faith that the disclosure is necessary to protect the personal safety of OurFamilyWizard, its employees and customers, or the public. Also, we may disclose Personal Information in connection with (but not limited to) the following circumstances:
- Certain Business Transfers. We may disclose Personal Information as part of a corporate business transaction, such as a merger or acquisition, joint venture, corporate reorganization, financing, or sale of company assets (including for due diligence purposes for a proposed commercial business transaction). We may also disclose Personal Information in the event of insolvency, bankruptcy, or receivership in which Personal Information could be transferred to third parties as one of the business assets in the transaction.
- Promoted Services. Some services in connection with the Platforms may be proposed and offered together with another company. If you register for or use these services, both OurFamilyWizard and the other company may receive your Personal Information collected in connection with the promoted services.
- Monitoring and Usage Analysis. We may transfer aggregated data to third party partners to monitor the effectiveness of our Platforms and our marketing campaigns, to monitor aggregate metrics like total number of visitors, users, traffic, and demographic patterns, and to diagnose or fix technology problems reported by our users or engineers that are associated with certain IP addresses or User IDs.
- Promoted Services. Some other services may be proposed and offered in the Platforms by OurFamilyWizard. If you register for or use these services, you will be bound by the Terms and Privacy Policies of the promoted service.
- Other Purposes. We may disclose Personal Information as consented to by you from time to time, including to fulfill any other purposes that are identified when the Personal Information is collected.
We will use measures as required by law to protect the security of the Personal Information transferred. Some jurisdictions only allow disclosure of account information and content (including the content of communications) if it is provided by law or pursuant to court order, so the above section may not apply to you.
Cookies and Other Technologies
Our websites, services, interactive applications, email messages and advertisements may use “cookies” and other mechanisms such as pixel tags, flash cookies and web beacons.
A "cookie" is a small data file that the Service transfers to your computer for storage to allow our server to “store” or "remember" specific information. These technologies help us to better understand user behavior and use of the Platforms which allow us to analyze trends and also to administer the Platforms. We may use "cookies" and other tracking mechanisms to help support the integrity of registration processes on the Platforms and to track marketing efforts.
We also allow third party service providers to collect information to help us track and aggregate individual use of the Platforms. We treat most information collected by cookies and other technologies as Non-Personal Information. However, to the extent that any information is considered Personal Information by local law, we will treat it as Personal Information.
We and our partners may also use cookies and other technologies to remember Personal Information when you use our Platforms, services and applications, in order to retain changes that you make and to improve your user experience.
We use the following cookies:
- Strictly necessary cookies. Some cookies are strictly necessary to make our Platforms available to you; for example, to perform your login functionality and for user authentication and security. We cannot provide you with the Services without this type of cookies;
- Functional cookies. These are used to recognize you when you return to our Website. This enables us to personalize our content for you, greet you by name and remember your preferences (for example, your choice of language or region);
- Analytical or performance cookies. We also use cookies for analytics purposes in order to operate, maintain, and improve our Platforms. We use third party analytics providers, including Google Analytics and Firebase, to help us understand how users engage with the Platforms. Google Analytics and Firebase use first-party cookies to track user interactions which helps show how users use our Platforms. This information is used to compile reports and to help us improve our services. The reports disclose website trends without identifying individual visitors. You can opt out of Google Analytics without affecting how you visit our Platforms by going to https://tools.google.com/dlpage/gaoptout or via Google's Ads settings.
By providing your contact information and information about your device, you are able to register your products with us and we are able to provide you with an improved service. You do not have to choose to accept cookies. In certain jurisdictions, cookies that are not strictly necessary to provide you with services that you have not been explicitly requested, cannot be used without your prior consent. When you choose not to accept all types of cookies, certain service features and functionality may no longer work properly, or at all. Children’s Privacy
We do not knowingly allow anyone under the age of 16 to provide us with any personal information. In order to register and create a Cozi account, you must be 18 years of age or older. Children should always get permission from their parents before sharing any personal information about themselves over the Internet. If you're under 16, please do not register the Services or provide us with any personal information (such as your name, e-mail address, or phone number).
If you are a Cozi user, you may, at any time, direct Cozi to delete all personal information regarding you or your family that you have provided or that has been collected from your family. To do so, please visit this page.
Communication Preferences
If you have consented to receive marketing communications, we may send you emails to inform you about products, services or other marketing materials, which we consider may be of interest to you, or that you have otherwise agreed to receive. You may opt-out of receiving future marketing communications from us by following the instructions in the relevant communication. If you opt-out of receiving future marketing emails, we may still send you service communications such as (but not limited to) support, software and security updates and product recall information.
Your rights to access and update to Personal information
You may be able to access, copy, update, and delete your Personal Information, to the extent it is not otherwise required to be retained by law, through the Platforms by changing registration information you provide in connection with the Platforms. You will be required to sign in with your user name and password. We may keep records of changes to your Personal Information (including deletions). You can delete your account via an email request to us. We will respond to your request and stop processing your information 28 days after receiving such request.
California Residents. We will not share any personal information about you with other companies if prohibited by applicable California law or to the extent your prior consent to share is required by applicable California law.
If you are a California resident, you may have certain rights with respect to your Personal Information including the following rights:
- The right to know, by way of our Privacy Policy and any specific inquiries you direct to us, where personal information we have about you comes from, what we use that information for, whether it is being disclosed or sold, and to whom it is being disclosed or sold;
- The right to “opt-out” of the sale of your Personal Information to any third parties;
- The right, with some exceptions, to have your Personal Information deleted from our possession or control;
- The right, under certain circumstances, to correct your personal data that we possess; and

International Transfers. We share your personal data within our corporate group. This will involve transferring your data, including to our overseas offices in the United States. We may also transfer your personal data to service providers that carry out certain functions on our behalf. This may involve transferring personal data to countries which have laws that do not provide the same level of data protection.
Whenever we transfer your personal data, we ensure appropriate safeguards are in place, including:

- Access. You have the right to know if we are processing Personal Data about you and, if so, to access and obtain a copy of Personal Data about you, as well as information relating to the processing of that data. This right does not allow you to access the Personal Data of others. Where possible we shall provide your Personal Data without disclosing any information that identifies another individual. If this is not possible, we may not be able to provide such data to you unless we obtain the consent of the other identified individuals or it is reasonable for us to comply with the request without obtaining consent. - Correction. You have the right to have us correct or update any Personal Data about you that is inaccurate or incomplete, though we may need to verify the accuracy of the new data you provide to us.
- Erasure. You have the right to request deletion or erasure of your Personal Data in certain circumstances, including:
- If the Personal Data is no longer necessary.
- When we rely on consent to process your Personal Data and you withdraw consent and we have no other lawful basis.
- When we rely on legitimate interests and you object to our processing.

Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

- If you want us to establish the data's accuracy.
- Where our use of the data is unlawful but you do not want us to erase it.
- Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.
- You have objected to our use of your data, though in this case, we would first need to verify whether we have overriding legitimate grounds to use it.
- Withdrawal of Consent. When we rely on consent as the basis for processing Personal Data, you have the right to withdraw your consent. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

You have the right to object to our processing of your Personal Data when we are relying on legitimate interests as our legal basis and your rights override our legitimate interests in processing their personal data. As with your right of erasure, we may not always be able to comply with your request to restrict processing for specific legal reasons which will be notified to you, if applicable, at the time of your request.

As with your right of erasure, we may not always be able to comply with your request to restrict processing for specific legal reasons which will be notified to you, if applicable, at the time of your request.
You also have the right to object to our processing of your Personal Data for direct marketing purposes.
You will not have to pay a fee to access your Personal Data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.
We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data (or to exercise any of your other rights). This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

We commit to resolve complaints about our collection or use of your Personal Information.
